Who owns MAX-FX?

I'm just curious here. Since Remedy developed the engine for Max Payne in-house, but they sold the rights to Take Two, did Remedy hold onto their engine? And if so, has there been any thought of releasing the source code?

Remedy owns it but Take 2 owns a license to it.
